Waiver, Release & Assumption of Risk Form

The following is an important legal document. It explains the assumption of any and all risks in deciding to follow the advice or insight from intuitive consultant Cheryl McCallister, who operates as an advising consultant, energy healer, spiritual channel, and teacher. Therefore, it is critical that you read and understand it completely.

Waiver, Informed Consent, and Covenant Not to Sue

I hereby acknowledge that I have volunteered to participate in a paid or unpaid session, workshop, or program with Cheryl McCallister, to include, but also may not be limited to, any and all services provided, such as energy healing, intuitive and transformational coaching, channeled spiritual guidance, and any workshop, membership, or program attendance.

In consideration of Cheryl McCallister, the agreement to instruct, assist, advise, or train me, I do here and forever release and discharge and hereby hold harmless Cheryl McCallister, her Companies, and its respective agents, heirs, assignees, contractors, and employees from any and all claims, demands, damages, rights of action or causes of action, present or future, arising out of or connected with my participation in a session or purchase or any program WITHOUT LIMITATION, WHICH MAY OCCUR AS A RESULT OF following advice tendered and released or training rendered or use of facilities during a session or event.

I recognize that in no way does Cheryl McCallister or any member associated with her Company provide legal, medical, or therapeutic advice, and it is my responsibility to secure such advisement. I acknowledge and agree that I assume the risks associated with any and all activities, offerings, products, services, classes and/or programs in which I participate or purchase, including any interactions with prescription drugs, over the counter medications/supplements, alcohol, and legal and illegal substances.

Cheryl McCallister is NOT a Physician, Psychiatrist, Psychologist, or Medical Doctor and makes no claim to diagnose or offer treatment of disease.

I acknowledge and agree that I assume the risks associated with any and all activities and/or programs I participate in now or in the future.

I acknowledge and agree that no warranties or representations have been made to me regarding the results I will achieve from any insight or program. I understand that results are individual and may vary.

Waiver, Release, and Assumption of Risk Form for Cheryl McCallister and Company specifically regarding classes and programs

This Addendum is an extension of our Waiver, Release, and Assumption of Risk Form for working with Cheryl McCallister and her company representatives. Specifically, it relates to participation in any classes, workshops, or memberships related to the Divine Prescriptions Membership (DPM) and all other future courses and curriculum. 

We recognize that sometimes a class, session, membership, or experience with Cheryl McCallister may create challenges within an individual that the class or its representatives cannot assist with, such as triggering childhood issues or bringing up unhealed trauma. We also recognize that, though infrequently, a class member may cause undue stress or discomfort for other classmates, the teachers, and their representatives. Because of this, and if deemed appropriate and necessary, Cheryl McCallister and all authorities under Cheryl McCallister within classes, group coaching, and memberships have the right to end our association with a participant immediately without prior notice. Cheryl McCallister reserves the right to remove any participant if deemed necessary for the comfort, convenience or safety of other participants, including if Candidate/Attendee’s behavior is deemed to cause or be likely to cause danger, distress, or annoyance to other participants, or if it is reasonably determined Candidate’s conduct would adversely affect Candidate’s health, safety, or enjoyment or that of other participants. If Candidate is removed after commencement of any program or membership, Candidate will not be entitled to any refund, payment, compensation or credit of any kind for fees for anything, including unused or missed services, or for any and all costs incurred resulting from the removal. We also hold the right to disconnect such individuals from all social media or shared class sites and forums or materials. 

Membership Responsibility, Privacy, and Conduct

I herby agree my attendance to, viewing, or reviewing of any recorded material associated with the Divine Prescriptions Membership is expressly for my use and my use only and that I will not share this material anywhere including on any social media platforms, discuss information from live or recording DPM material on social media platforms, or share specific information about other attendees that could harm other members within the program either recorded or live. 

I agree that when discussing information Cheryl McCallister teaches, coaches, and specifically in questions and answer portions of the Divine Prescriptions Membership, with friends, family, and others, that I will not use any personal names, information, or details that would make members known to others, expressly maintaining their privacy rights in attendance to all DPM meetings. I understand I am held responsible in making sure all members feel safe, secure, and comfortable in attending the Divine Prescriptions Membership so others can express themselves, including personal information, in order to receive the maximum benefit of the membership program. 

Loving Self-Awareness Commitment

I hereby commit to cultivating compassionate, non-judgmental awareness of myself and others in any program, membership, or event with Cheryl McCallister, including but not limited to the Divine Prescriptions Membership. I commit to being gentle and kind with myself and others during any group membership, course, workshop, or service provided by Cheryl McCallister. 

Audiovisual Recording and Use of Material

Matters regarding your sessions will be kept confidential except in the following circumstances: The Divine Prescriptions Membership and Cheryl McCallister reserves the right to video and record during all programs and DPM meetings, and to provide access to view and listen to those recordings for all DPM purchases under the terms of purchase. All recorded and reviewed material is for educational purposes. The candidate grants Cheryl McCallister the absolute and irrevocable right and unrestricted permission to use and publish the Candidates image or likeness, audios, and vocals without compensation, for commercial, advertising, editorial, DPM portal purchases and sharing, or any other purpose; and in any manner and medium, whether now known or hereafter devised; and to alter and composite the same without restriction and without Candidate’s inspection or approval. Candidate hereby releases, waives and discharges Cheryl McCallister, the Divine Prescriptions Membership, and any and all attendees from and against any and all claims, liabilities, costs, damages and expenses of any kind arising out of or relating to the use by Cheryl McCallister of Candidate’s image, likeness, or voice. Candidate acknowledges that during live events recorded, virtual, and streamed online or otherwise, is in real time, and there is no opportunity for Cheryl McCallister to edit any image or prevent the use of Candidate’s image, likeness, or voice during the live real time shot. Therefore, if Candidate does not want Candidate’s image, likeness, or voice to be included in a live real time feed, Candidate must choose not to attend the live event, turn off camera, and/or must be held exclusively responsible for avoiding being recorded.”

I ACKNOWLEDGE THAT I HAVE THOROUGHLY READ THIS WAIVER AND RELEASE AND ADDENDUM AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY.

THEREFORE, BY VISITING CHERYL MCCALLISTER’S WEBSITE, READING THIS DOCUMENT, OR PURCHASING OR USING PRODUCTS, MEMBERSHIPS, OR SERVICES, I AM WAIVING ANY RIGHT I OR MY SUCCESSORS MIGHT HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST CHERYL MCCALLISTER AND HER SUCCESSORS, FOR YOUR NEGLIGENCE OR DECISIONS OR THAT OF YOUR EMPLOYEES, AGENTS, REPRESENTATIVES, OR CONTRACTORS.
